I have enrolled in a program of instruction offered by Illuminey LLC.  I agree to willingly participate in a progressive physical exercise program, including, but not limited to, Pilates, aerobic exercise/cardiovascular conditioning, endurance training, flexibility work and stretching, strength training, and mobility re-education, led by the instructors at Illuminey LLC.  The possible benefits of this physical exercise program include: improving cardiovascular fitness, gaining muscle strength/endurance/flexibility, and improving body posture and alignment.  

I fully acknowledge that exercise carries some risk of injury and/or disability to the musculoskeletal system and the cardiovascular system and by voluntarily participating  in these forms of physical exercise and utilizing equipment at my own risk I am willingly engaging in these forms of physical exercise mentioned above.  

I accept responsibility for self-awareness during exercise sessions to notice any abnormal physical changes or pain that may occur and will verbally communicate that to my instructors at Illuminey LLC.  If I experience any pain or discomfort, I shall immediately stop, and communicate that to my instructor. I also understand that a medical evaluation is advisable before commencing any program of physical conditioning or exercise. I have and will continue to keep the instructors at Iluminey LLC. fully informed of any physical condition or disability, which would prevent or limit my participation on an exercise program.

I acknowledge that, although the program may have substantial physical benefits, Illuminey LLC practitioners do not engage in diagnosing or treating medical diseases or deficiencies.

The possibility of certain unusual changes during exercise does exist. They include such conditions as, muscle soreness or stiffness, abnormal blood pressure, fainting, abnormal heartbeats and instances of possible heart attack or death. I hereby acknowledge and accept these risks.  

To my knowledge, I do not have any limiting physical conditions or disability that would preclude me from participating in an exercise program. I hereby certify that I know of no medical problem that would increase my risk of illness and injury as a result of participation in a regular exercise program. My instructor is aware of any past or recent medical history. *Note:  If you are recovering from a surgery, have experienced a recent medical event, are currently pregnant, have become pregnant or are in postpartum recovery, please obtain clearance from a medical physician prior to engaging in a new form of physical exercise or movement.*

I waive, indemnify, exonerate, hold harmless the instructors at Illuminey LLC and assigns for any claims, demands and causes of action (including attorney’s fees) arising out of or pertaining to any loss, damage, injury or death sustained, caused by any negligent act or act of omission or my participation in the program designed by Illuminey LLC or breach of duty related to the instructors at Illuminey LLC.

This release applies whether or not any claim, demand, action or suite is based upon or alleged to be based on or in part, the negligent act or act of omission or similar conduct of those parties are hereby released and indemnified. I do hereby assume all risk and hazards in volunteering to participate in this fitness program.

I hereby acknowledge that I possess adequate medical and hospitalization insurance coverage in case of injury. I further acknowledge that I might have the right to choose what exercises I do or do not perform in addition to withdrawing from any exercise at anytime.  

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS CONSENT AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY. IN ADDITION, I DO HEREBY WAIVE ANY RIGHT THAT I MAY HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST ME FOR MY NEGLIGENCE OR ARISING OUT OF OR RELATING TO PARTICIPATION BY ME IN ANY OF THE ACTIVITIES, OR USE OF ANY EQUIPMENT, FACILITIES OR SERVICES PROVIDED.
